No to strict liability
No 10 has responded to the e-petition requesting strict liability for motorists. In many EU countries, when there is a collision involving a motorist, the burden of proof is with the motorist to demonstrate they are not at fault. Petitioners believe that this should also be the situation in the UK. No 10’s response is that the current law is adequate and fairly judges accidents on a case-by-case basis. In conclusion, “It would not be appropriate to change the law”.
